Terms of Service

The APFA service at https://aiproductflowapp.com (the "Service") is provided by Jason Yates, a sole proprietor doing business as APFA (AI Product Flow App), operating from the State of Florida, USA ("APFA", "we", "us" or "our"). You can reach us at [email protected]. By creating an account, starting a trial or using the Service, you agree to these Terms. If you use the Service for a business, you confirm you are authorized to accept these Terms on its behalf.

APFA is a subscription software-as-a-service platform for print-on-demand sellers. Depending on your plan, it provides:

• AI-assisted trend discovery and opportunity scoring from public sources
• AI-generated product listings and content
• Automated intellectual-property (IP) risk screening with an owner approval queue
• Publishing and syncing of products to stores you own and connect (for example Printify, Shopify and Etsy through Printify)
• Analytics and team workspaces

We may improve, change or discontinue features over time. If we remove a core feature of a paid plan, we will give reasonable notice.

You must be at least 18 years old and give accurate information when you sign up. You are responsible for keeping your login details secure and for all activity in your workspace, including activity by team members you invite. Tell us promptly if you suspect unauthorized access.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Paid plans are billed in advance on a monthly or annual basis at the prices shown on our Pricing page. Taxes are calculated at checkout. Subscriptions renew automatically at the end of each billing period until cancelled.

Where a plan includes a free trial (currently the Pro plan, 7 days), a payment method is required at sign-up and you will be charged when the trial ends unless you cancel before then.

You can upgrade, downgrade or cancel at any time from the Billing page. Plan changes are prorated by Paddle. Cancellation stops future renewals and your access continues until the end of the period already paid for.

Promotional discounts (such as the Founding Member discount) apply only as described in the offer and only while the subscription stays active.

Refunds are covered by our Refund Policy.

Each plan has usage limits (for example store connections, AI listings, published products and team members) shown on the Pricing page. "Unlimited" features are subject to fair use: we may limit use that is abusive or that degrades the Service for other customers.

You keep all rights to the content you upload or create in the Service, including designs, listings and store data ("Your Content"). You give us a limited licence to host, process and transmit Your Content only as needed to run the Service for you.

When you connect a third-party store or platform, you authorize us to access it on your behalf. Your use of those platforms is governed by their own terms, and we are not responsible for their availability, fees or decisions (such as listing removals or account suspensions).

AI-generated trends, scores, listings and designs may be inaccurate, incomplete or similar to existing works. The IP screening in the Service is an automated risk indicator only. It is not legal advice and it is not formal legal clearance.

You are solely responsible for reviewing and approving anything before it is published, and for ensuring that your products, listings and advertising do not infringe trademarks, copyrights, rights of publicity or other rights and comply with applicable laws and platform policies.

You agree not to:

• Use the Service to create or sell infringing, counterfeit, unlawful, hateful or deceptive products
• Attempt to access other customers' workspaces or data, or probe, scan or disrupt the Service
• Reverse engineer, resell or sublicense the Service except as we allow in writing
• Use the Service to send spam or to scrape third-party sites in breach of their terms

We may suspend or terminate accounts that breach these Terms or put the Service, other customers or third parties at risk.

The Service, including its software, design, and the APFA name and logo, belongs to us and is protected by law. These Terms do not give you any rights to our brand or software beyond using the Service as permitted.

Our Privacy Notice explains how we collect and use personal data. By using the Service you acknowledge that notice.

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee any sales, revenue, rankings or business results.

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid for the Service in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law, or your statutory consumer rights.

You agree to indemnify us against claims, losses and costs (including reasonable legal fees) arising from Your Content, the products you publish or sell, or your breach of these Terms or of any law or third-party right.

You may stop using the Service and cancel your subscription at any time. We may suspend or end your access if you breach these Terms or fail to pay. After termination, we may delete your workspace data in line with our Privacy Notice. Sections that by their nature should survive termination will survive.

We may update these Terms from time to time. We will post the updated version on this page with a new "last updated" date and, for material changes, notify account owners by email or in the app. Continuing to use the Service after changes take effect means you accept them.

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts sitting in Florida, except where your local mandatory consumer protection laws give you the right to rely on the laws or courts of your country of residence.
